Terms of service

1. Who we are

Neario Dineout is a dine-in ordering platform operated from Bengaluru, India. It gives each registered restaurant a guest menu, a staff app for waiters and the kitchen, and an owner dashboard, at its own web address. In these terms, “we” means Neario Dineout and “you” means the restaurant (and the owner who registers it).

2. Your account

• The person registering must be authorised to act for the restaurant and must give accurate contact details.
• You are responsible for the staff accounts you create and for keeping passwords private.
• Your web address (subdomain) is yours while your account is active. We may refuse or reclaim names that are misleading, offensive or infringe someone else's rights.

3. Price

The software is free for restaurants: no subscription, no setup fee and no upfront payment, with every feature included. Each paid guest bill carries a fixed platform fee, shown to the guest as a separate line. You collect the fee with the bill, and it is deducted from your prepaid platform wallet, which you recharge from your dashboard. 4. Payments from guests

Guests pay the full bill directly to your restaurant's own UPI ID. We do not receive, hold or settle guest payments on your behalf, and we are not a payment service. You are responsible for your prices, your taxes (including GST on food and drinks) and any refunds to guests.

5. Your content

Your menu, photos, logo and other content remain yours. You give us permission to store and display them so the platform can work for you and your guests. Please only upload content you have the right to use.

6. Fair use

• Don't use the platform for anything unlawful, or to mislead guests about prices or charges.
• Don't try to remove, hide or work around the platform fee line on bills.
• Don't interfere with the service, other restaurants or their data.

7. Pausing new table sessions

If your wallet runs past the grace limit in the platform fee policy, new table sessions pause until you recharge. Tables that are already seated are never interrupted, and an in-progress bill can always be paid. We may also suspend accounts that break these terms, after telling you why where we reasonably can.

8. Availability

We work hard to keep Neario Dineout running smoothly, but we can't promise it will never be interrupted. We may change or improve features over time and will tell you in advance about changes that materially affect you.

9. Ending

You can stop using Neario Dineout at any time. Any negative wallet balance already incurred remains payable, and remaining wallet balance is not refundable or withdrawable. We may close accounts that have been inactive for a long period, with notice.

10. Liability

To the extent the law allows, we are not liable for indirect losses, lost profits or problems caused by things outside our reasonable control, such as network outages or third-party UPI apps.

11. Changes and contact

We may update these terms and will notify registered restaurants of significant changes. Questions: info@neariodineout.in.
